Terms of Service

These Terms describe how you can use SchengenTracker. Please read them carefully—by accessing our platform you agree to the obligations, limits, and protections outlined below.

1. Introduction & Acceptance

By using our website, platform, or related services (“Service”), you agree to these Terms of Service and confirm you have the authority to bind your organisation if you act on its behalf. If you disagree with any part, do not access the Service.

2. What the Service Provides

We deliver software that helps transport organisations track driver compliance with Schengen regulations. The Service includes stay calculations, alerts, reporting, documentation, and third-party integrations to support your compliance workflows.

3. Important Disclaimers

  • The Service is informational software—not legal or immigration advice.
  • You remain responsible for complying with all visa, immigration, and border rules.
  • Regulations change often; we cannot guarantee accuracy or legal sufficiency.
  • Consult qualified immigration professionals when you need definitive guidance.

4. Accounts & Eligibility

Provide accurate information, safeguard your credentials, and notify us of any unauthorised use. You must be at least 18, have capacity to contract, and use the platform for business purposes. We may suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

5. Subscriptions & Payments

The Service is billed monthly or annually via third-party processors. Plans renew automatically unless you cancel before renewal. We may update pricing with 30 days’ notice; cancelling takes effect at the end of the current billing cycle. Free trials (when offered) follow the terms shown at signup.

6. Data & Privacy

You retain ownership of any information you enter (“User Data”). You grant us a limited licence to use that data to operate and improve the Service, subject to our Privacy Policy. We apply reasonable security controls but no method is flawless. We retain data while your account is active and delete or anonymise it within a reasonable period after closure unless the law requires longer retention.

7. Acceptable Use Rules

Don’t break laws, upload harmful content, interfere with the Service, reverse engineer our code, or use automated systems without permission. Do not resell or redistribute the Service, submit false data, or leverage the platform to facilitate immigration fraud.

8. Intellectual Property

All software, designs, and content (excluding User Data) belong to SchengenTracker. You receive a limited licence to use them under these Terms, and you may not use our trademarks without consent. Feedback you provide may be used freely.

9. Third-Party Integrations

Integrations may link to third-party services governed by their own terms and privacy policies. We are not responsible for their content or actions.

10. Liability Limits

The Service is provided “as is.” We are not responsible for compliance failures, penalties, or indirect damages. Total liability is capped at the greater of £100 or the fees you paid in the preceding 12 months, unless local law prevents that limitation.

11. Your Indemnity

You agree to defend and indemnify us against claims arising from your use of the Service, your data, violations of these Terms, or legal non-compliance.

12. Changes to Service or Terms

We may update functionality or these Terms at any time. We’ll post changes and update the “Last Updated” date; continuing to use the Service means you accept the updated Terms.

13. Termination

You can cancel whenever you like. We may suspend or terminate accounts immediately for violations, legal demands, or security risks. After termination we may remove your data following a reasonable retention period; relevant obligations survive.

14. Disputes & Governing Law

These Terms follow the laws of England and Wales, and its courts have exclusive jurisdiction unless arbitration is required. Please contact [email protected] before starting formal proceedings; arbitration may follow if a dispute isn’t resolved within 60 days (unless you opt out within 30 days of agreeing to these Terms).

15. General Legal Stuff

  • These Terms plus our Privacy Policy form the entire agreement.
  • Not enforcing a clause doesn’t waive our rights.
  • If a clause is invalid, the rest stays in force.
  • You can’t assign your rights without consent; we may assign freely.
  • We’re not liable for delays caused by events beyond our control.
  • Official notices to us: [email protected].
  • These Terms don’t create an agency, partnership, or employment relationship.
